A settlement has been reached with PNI Digital Media (“PNI”) in a class action lawsuit about a data security incident that occurred between June 2014 and July 2015, during which PNI was the victim of a criminal cyberattack in which criminals accessed its computer systems (the “Security Incident”). A number of lawsuits were filed asserting claims against PNI relating to the Security Incident. PNI denies all of the claims and says it did not do anything wrong.
The Settlement Class includes all persons residing in the United States who made a payment to one or more Retailers (including CVS, Costco, and Rite Aid) for photo services using a credit, debit, or other payment card online between June 2014 and the end of July 2015, and whose payment card information was provided to PNI.
The Settlement provides two types of payments to people who submit valid claims: 1) Reimbursement of up to $250 for out-of-pocket expenses and documented lost time that resulted from the Security Incident; and 2) Reimbursement of up to $10,000 for extraordinary expenses which were more likely than not caused by the Security Incident.
